Is file-sharing legal in the USA?

can people download files from da internet through p2p software and not get caught by say the law enforcers or something... how do they know you download illegal mp3's anyway? it's not like the file has that type of info... i read somewhere that people have been sued because of downloading mp3's.. is that really possible?
